TERMS OF USE AND SALE - Update on January 3rd, 2025

Please read these terms of use (the "Terms of Use") carefully before using the transactional platform made available by Aqua Famille Plus, which includes the website accessible at www.aquafamilleplus.ca and any current or future downloadable electronic application published by Aqua Famille Plus (the "Platform").

1. PREAMBLE

This Platform is made available to Users by Aqua Famille Plus. The terms "User" and "you" refer to you as a user of this Platform, as a consumer or a visitor.

By using this Platform, you acknowledge and agree to these Terms of Use, without modification or qualification. These Terms of Use apply to all visits to the Platform both now and in the future.

Aqua Famille Plus reserves the right to amend these Terms of Use, at any time and without notice, by publishing a new version on the Platform. Any changes so made shall apply to your next use of the Platform.

If you do not agree to these Terms of Use, you may not access, view, obtain products or services from, or otherwise use the Platform.

The Platform provides an online environment where Aqua Famille Plus may offer and sell its products and services and where Users may browse, purchase and receive such products and services directly.

2. ELIGIBILITY AND AUTHORIZATION

To use the Platform, you must be of legal age and possess the capacity to enter into binding contracts. If using the Platform on behalf of someone else, you must be a person of full age. Aqua Famille Plus may validate your identity directly or through third parties.

3. USER NAME, ACCOUNT AND PASSWORD

Upon account creation, you are responsible for maintaining confidentiality of your login credentials. You must inform Aqua Famille Plus of any unauthorized access immediately. You are accountable for any use of your account.

4. NEWSLETTERS, SURVEYS AND CONTESTS

Aqua Famille Plus may promote its products and services through newsletters, surveys, or contests. Participation in such promotional activities is optional.

5. ERRONEOUS INFORMATION

While Aqua Famille Plus strives for accuracy in product information, pricing or descriptions may contain errors. Aqua Famille Plus may cancel any orders placed for items listed with incorrect information and will issue a refund where applicable.

6. CLOSING YOUR ACCOUNT

You may request account termination at any time. Even after termination, these Terms of Use remain applicable.

7. PROHIBITED CONTENT AND/OR ACTIVITY

Users shall not engage in any activity that interferes with Platform security or function, or involves unauthorized access to other accounts or data. Aqua Famille Plus may terminate accounts that violate these terms.

8. TRADEMARKS AND BUSINESS NAMES

All trademarks and trade names displayed on this Platform are the property of Aqua Famille Plus unless otherwise noted. You may not use them without express written permission.

9. EXCLUSION OF WARRANTY

This Platform is provided "as is." Aqua Famille Plus makes no warranties regarding the accuracy or reliability of Platform content and disclaims all implied warranties, including merchantability or fitness for a particular purpose.

10. LIMITATION OF LIABILITY

Aqua Famille Plus is not liable for any damages resulting from the use or inability to use the Platform.

11. VIOLATION OF TERMS AND INDEMNIFICATION

Report violations by emailing info@aquafamilleplus.ca. Users agree to indemnify Aqua Famille Plus for any damages caused by their breach of these Terms.

12. NO PARTNERSHIP OR AGENCY

Use of the Platform does not create any partnership, joint venture, employment or agency relationship between the User and Aqua Famille Plus.

13. PRIVACY

Aqua Famille Plus protects Users' personal information per its privacy policy. By using the Platform, you consent to collection and processing of your data as described in that policy.

14. MISCELLANEOUS

These Terms shall be governed by the laws of the Province of Quebec and the federal laws of Canada. If any provision is invalid, the remainder will remain in effect. These Terms constitute the entire agreement between you and Aqua Famille Plus.

15. ACKNOWLEDGEMENT

By using this Platform, you confirm that you have read, understood, and agreed to these Terms of Use.
