Please read these Terms of Use and Sale ("Terms") carefully before using the online platform operated by Aqua Famille Plus, including the website www.aquafamilleplus.ca and any current or future downloadable applications (collectively, the "Platform").

By accessing or using the Platform, you (“User,” “you”) agree to these Terms in full. If you do not agree, you must not use the Platform. These Terms apply to all interactions with the Platform, including browsing, ordering products, or using services.

Aqua Famille Plus reserves the right to modify these Terms at any time. Updates will be posted on the Platform, and continued use constitutes acceptance of the updated Terms.

1. Eligibility

To use the Platform, you must:

• Be of legal age and have the capacity to enter into binding contracts in Quebec and Canada.
• Provide accurate information when creating an account.
• Use the Platform only on your own behalf or on behalf of someone you are legally authorized to represent.

Aqua Famille Plus may verify your identity directly or through trusted third parties.

2. Account, Login & Security

If you create an account, you are responsible for maintaining the confidentiality of your username and password. You must notify Aqua Famille Plus immediately of any unauthorized access. You are responsible for all activity conducted through your account.

3. Newsletters, Surveys, and Contests

Participation in promotional emails, surveys, or contests is optional. By subscribing, you consent to receive communications in accordance with Canadian anti-spam laws (CASL). You may unsubscribe at any time.

4. Product Information & Ordering Errors

While Aqua Famille Plus strives for accuracy, product descriptions, availability, and pricing may contain errors. Aqua Famille Plus reserves the right to cancel or correct orders with inaccurate information and will issue refunds where applicable.

5. Termination of Account

You may request account closure at any time. Termination does not release you from obligations under these Terms for past activity. Aqua Famille Plus may also suspend or terminate accounts that violate these Terms.

6. Prohibited Conduct

Users must not:

• Interfere with Platform security or functionality.
• Access accounts or data without authorization.
• Use the Platform for unlawful purposes.

Accounts engaging in prohibited activity may be suspended or terminated without notice.

7. Intellectual Property

All trademarks, logos, and content on the Platform are the property of Aqua Famille Plus unless otherwise indicated. Users may not reproduce, distribute, or use these materials without express written permission.

8. Disclaimer of Warranties

The Platform is provided “as is”. Aqua Famille Plus disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, or accuracy of information.

9. Limitation of Liability

To the fullest extent permitted by law, Aqua Famille Plus is not liable for any damages arising from the use, inability to use, or errors in the Platform. This includes direct, indirect, incidental, or consequential damages.

10. Indemnification

Users agree to indemnify and hold harmless Aqua Famille Plus, its officers, and affiliates from any claims, damages, or expenses arising from a violation of these Terms. Violations may be reported to info@aquafamilleplus.ca.

11. No Partnership or Agency

Use of the Platform does not create any partnership, employment, agency, or joint venture relationship between Users and Aqua Famille Plus.

12. Privacy

Aqua Famille Plus collects and processes personal information in accordance with its Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection, use, and disclosure of personal information as described in that policy.

13. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. If any provision is found invalid, the remaining provisions will remain in effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aqua Famille Plus regarding your use of the Platform.
